“Accessible”
means a unit has disability-friendly features. Wider door, grab bars, more space. Better than standard but not necessarily legal compliance.
“ADA compliant”
means the unit meets every precise technical measurement required by the Americans with Disabilities Act Accessibility Guidelines door clearance, interior turning diameter, grab bar height and load rating, fixture positioning, and threshold height. ADA compliant units have a larger footprint of approximately 8 by 8 feet versus a standard 4 by 4 feet, are wheelchair accessible, and include handrails and lower fixtures.
or every 20 standard units or if disabled workers are on site, at least one ADA compliant construction site toilet must be provided. Even if no worker currently has a visible disability, injuries happen mid-project. One compliant unit from day one keeps you covered under OSHA Standard 29 CFR 1926.51.
Where multiple single-user portable toilet units are clustered at an event, at least 5% of the units must be accessible and marked with the International Symbol of Accessibility. If you provide only one unit, it must be accessible. This applies to any event open to the public festivals in Bloomfield, community fairs in Hamilton Township, charity runs in Cherry Hill.
Federal and state-funded construction contracts in NJ require documented ADA compliant facilities as a contract condition. Non-compliant facilities can trigger payment holds and project shutdowns.
Technically exempt from ADA mandates — but providing at least one accessible unit is strongly recommended. Private events like weddings and private parties are technically exempt from ADA requirements, but providing accessible units is best practice and inclusive.

For events with clustered units: At least 5% of clustered single-user units must be accessible. For 200 porta potties, that means at least 10 accessible units. For smaller events with fewer than 20 total units, minimum 1 ADA unit regardless of total count.
Up to 100 guests — 1 ADA unit minimum
100–250 guests — 1–2 ADA units
250–500 guests — 2–3 ADA units
500+ guests — 5% of total unit count, always rounded up
For every 20 standard units or if disabled workers are present, at least one ADA compliant unit is required. For sites with 200 or more workers, the ratio scales proportionally.

NJ contractors ask this often and nobody answers it directly.
An OSHA or ADA inspector on a job site will check whether compliant units are present, whether they’re placed correctly, and whether they’re maintained in sanitary and functional condition.
The fastest way to fall out of compliance is by neglecting the service schedule — OSHA mandates that all facilities must be maintained in a clean, sanitary, and serviceable condition. A dirty or non-functional unit does not count toward your compliance requirement, even if the unit itself is ADA certified.
They also check placement — units must be on firm, level ground with a clear 36-inch wide accessible path from the parking area or site entrance. Proper signage must be visible. Lighting is required for sites operating after dark.
Future Sanitation handles all of this. We document placement, maintain units on schedule, and provide written compliance records for your files.
This matters most for government projects, large public events, and any site subject to federal inspection.
Every Future Sanitation ADA compliant rental includes written documentation confirming units meet federal ADA specifications. This covers dimensional verification of door clearance and interior turning space, grab bar placement and load rating, fixture heights, threshold measurement, and placement compliance with accessible route requirements. If an inspector, auditor, or attorney requests proof of compliance, you have it ready.
This is a standard part of every ADA rental — not an add-on, not an extra charge.
An ADA compliant porta potty runs approximately $295 per week and around $348 per month. ADA compliant units carry a cost premium of 25 to 40% over standard units due to their larger footprint, engineered grab bars, and precision manufacturing. In New Jersey, that premium is consistently justified by the legal protection it provides

The general rule is 1 unit per 50 guests for a 4-hour event. Add 15–20% more if alcohol is served. Construction sites require 1 unit per 20 workers minimum. At least 5% must be ADA accessible.
Every portable toilet rental includes weekly servicing tank emptying, power-washing, sanitizing, and full restocking. High-traffic events receive more frequent service. You will never need to call us requesting a cleaning.
